Granny flat exemptions commence to boost housing diversity

On 10 April 2024, a media release from Minister John Carey was published regarding amendments to Residential Design Codes (R-Codes). These changes are aimed at boosting housing supply by removing minimum lot size requirements for an ancillary dwelling, commonly known as a granny flat.

Please keep in mind that granny flats will still need to meet setback requirements, must not exceed 70 square metres, and must obtain a building permit. Residential property owners should contact the Shire for further information about building an ancillary dwelling.

It is important to note that a Building Permit Application must have been submitted and approved, with a Permit issued to the responsible person, prior to the construction of the granny flat.

 

Relaxed amendments to Residential Design Codes (R-Codes) aimed at boosting housing supply by removing minimum lot size requirements for an ancillary dwelling in the Residential Zone where the R-Codes apply - commonly known as a granny flat - have taken effect. From 10 April 2024:

  • R-code compliant granny flats on residential lots of any size in Western Australia will not require planning approval, allowing homeowners to simply seek a building permit,
  • granny flats will no longer be required to be compatible with the design of the existing dwelling,
  • the minimum lot size requirement of 350 square metres has been removed opening up greater diversity of housing choice, while ancillary dwellings will now also be permitted in grouped dwellings and strata lots.
